Terms of Service

1. Description of Service

Sumi is a private skin journal that captures face photos, sends them through our Cloudflare Worker to Google's Gemini AI for skin marker analysis, stores downscaled thumbnails in private Cloudflare R2 through authenticated Convex media routes, and stores the resulting marker readings, notes, routines, and thumbnail metadata in your private account. Sumi Pro is sold as a paid subscription, and access to premium scan and routine features requires an active subscription.

2. Eligibility

You must be at least 13 years old to use Sumi. By using the app, you represent that you meet this age requirement and that you have the legal capacity to agree to these Terms.

3. Accounts

To use Sumi you must create an account through our authentication provider, Clerk, using Sign in with Apple or Google. You are responsible for maintaining the security of the underlying Apple ID or Google account you use to sign in. Notify us promptly at [email protected] if you suspect unauthorized access.

4. Subscriptions and Payments

Subscription Plans

Sumi Pro is available as:

• Weekly subscription: Billed weekly
• Annual subscription: Billed annually

Billing

• Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

Cancellation

• You may cancel your subscription at any time through your Apple ID account settings or the App Store.
• Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that period ends.
• No partial refunds are provided for unused portions of a subscription period.

Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple at reportaproblem.apple.com.

5. Acceptable Use

You agree not to use Sumi to:

• Upload photos of any person other than yourself, or photos of anyone who has not consented to being photographed and analyzed
• Upload content that is illegal, abusive, sexually explicit (including content involving minors), violent, hateful, or otherwise objectionable
• Upload content that you do not have the legal right to upload
• Attempt to reverse-engineer, decompile, scrape, or tamper with the app, our Cloudflare Worker, our backend, or any of our third-party providers
• Interfere with or disrupt the app's infrastructure, security, or services, including by submitting prompts intended to manipulate or jailbreak the AI
• Use the app in any manner that violates applicable laws or regulations

We reserve the right, but have no obligation, to remove content or terminate accounts that violate these rules.

6. AI-Generated Content and Medical Disclaimer

Sumi uses third-party AI (Google Gemini) to estimate visual skin markers and generate gentle insights. This content is:

• For informational and self-reflection purposes only — not professional advice
• Not a medical device — Sumi does not diagnose, treat, cure, or prevent any disease or skin condition
• Generated by AI — and may contain inaccuracies, omissions, or errors
• Not a substitute for the advice of a licensed dermatologist or other qualified healthcare professional

Always consult a qualified healthcare professional for any medical concern about your skin. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated insight.

7. Your Content

• You retain ownership of all photos, scans, notes, and routine data you create using Sumi.
• By uploading a scan, you grant us a limited, non-exclusive, royalty-free license to transmit and process your photo solely for the purpose of providing the service to you (including transmitting it through our Cloudflare Worker to Google Gemini for analysis, storing a downscaled thumbnail in private media storage, and storing the resulting markers in your private account).
• We do not use your scans, photos, notes, or markers to train AI models, nor do we authorize our providers to do so.
• You can delete individual scans, products, or your entire account at any time from within the app.

8. Intellectual Property

Sumi, including its design, code, branding, illustrations, copy, and features, is the property of Solyx Studios LLC. You may not copy, modify, distribute, sell, or create derivative works based on the app without our written permission.

9. Third-Party Services

Sumi relies on third-party services including Apple, Google (Gemini), Cloudflare, Convex, Clerk, and RevenueCat. Your use of those services through Sumi is also subject to each provider's terms and privacy policy. We are not responsible for the acts or omissions of those providers.

10. Disclaimer of Warranties

Sumi is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The app will be uninterrupted, error-free, or secure
• AI-generated insights or marker readings will be accurate or reliable
• The app will meet your specific requirements

11. Limitation of Liability

To the maximum extent permitted by applicable law, Solyx Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from:

• Your use of or inability to use Sumi
• Any AI-generated content, marker readings, or insights
• Any decisions you make about your skin, products, or routine based on the app
• Unauthorized access to your data
• Any other matter relating to Sumi

12. Changes to These Terms

We may update these Terms from time to time. Continued use of Sumi after changes are posted constitutes your acceptance of the updated Terms. We will update the "Last Updated" date at the top of this page when material changes are made.

13. Termination

We reserve the right to suspend or terminate your access to Sumi at any time, for any reason, including violation of these Terms. Upon termination, your right to use the app ceases immediately. You may also terminate your account at any time from within the app.
